ACCOUNTABILITY

At CHIKIDS, we value our relationship with our clients and respect their privacy. Accordingly, CHIKIDS is accountable and responsible for the safeguarding of personal information in our custody or under our control. CHIKIDS has implemented procedures for the handling of personal information, and has developed a complaint process for clients with personal information concerns.

CONSENT

CHIKIDS will obtain your consent to collect, use or disclose personal information (except where authorized or required by law to do so without consent). Consent can be express, implied, or given through an authorized representative such as parent or guardian, lawyer or agent. You have the right to refuse or withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. You may have your name removed from our telephone, mail or email lists. However, withdrawal of consent may limit our ability to communicate with and serve you.

DISCLOSURE

Please note that there are circumstances where the use and/or disclosure of Personal Information may be justified or permitted or where CHIKIDS is obliged to disclose information without consent. Such circumstances may include:

• Where it is disclosed to a person who, in the reasonable judgment of CHIKIDS, is an agent of you (such as a parent enquiring on behalf of a child)’
• Where required by law or by order or requirement of a court, administrative agency or other governmental tribunal;
• Where CHIKIDS believes, upon reasonable grounds, that it is necessary to protect the rights, privacy, safety or property of an identifiable person or group, including of CHIKIDS;
• Where it is necessary to establish or collect monies owing to CHIKIDS;
• Where it is necessary to permit CHIKIDS to pursue available remedies or limit any damages that CHIKIDS may sustain; or
• Where the information is public.
• Where obliged or permitted to disclose information without consent, CHIKIDS will not disclose more information than is required.

ACCURACY

CHIKIDS will make every reasonable effort to ensure that your Personal Information as used or disclosed by CHIKIDS is accurate and complete.

RETENTION

CHIKIDS keeps Personal Information only as long as it is required for the reasons it was collected. The length of time we retain information varies, depending on the product or service and the nature of the information. This period may extend beyond the end of a person’s relationship with us but it will be only for so long as it is necessary for us to have sufficient information to respond to any issues that may arise at a later date. When your Personal Information is no longer required for our purposes, we have procedures to destroy, delete, erase or convert it into an anonymous form.
CHIKIDS transmits and stores files electronically, on a wide variety of platforms which may include third-party, cloud-based services that store information within the United States. You specifically consent to CHIKIDS’s use of these services and acknowledge and agree that such information transmitted to such third party providers located in the United States may be accessed by the courts, law enforcement or national security authorities of the United States.

SECURITY

CHIKIDS will protect your Personal Information in its custody or control by making security arrangements to prevent unauthorized access, collection or use. Yogabuttons has taken steps to maintain adequate physical, procedural and technical security with respect to its information storage facilities so as to prevent any loss, misuse, unauthorized access, disclosure, or modification of Personal Information.
In terms of communicating Personal Information to Yogabuttons, you may wish to note that there is no method of transmitting or storing data that is completely secure. While the physical characteristics of each are different, mail, telephone calls, faxes and transmissions over the Internet are all susceptible to possible loss, misrouting, interception and misuse of the information being communicated or transmitted.

OPENESS

You have the right to access your Personal Information through the CHIKIDS Privacy Officer. Unless prevented by law, CHIKIDS will provide you with information regarding your Personal Information and give you the opportunity to correct any errors of fact.
